PERSONAL DATA PROCESSING INFORMATION TEXT

1. Identity of the Data Controller

This information has been prepared by the Ministry of Interior pursuant to Article 10 of Law No. 6698 on the Protection of Personal Data (KVK Law) and the Communiqué on the Procedures and Principles to be Followed in Fulfilling the Information Obligation.

2. Purposes of Processing Your Personal Data

The General Directorate of Population and Citizenship Affairs (NVİGM) of the Ministry of Interior processes your personal data for the following purposes:

• Fulfilling legal obligations in accordance with the principles and procedures stipulated by legislation or as otherwise mandated,
• Carrying out institutional activities,
• Providing services to recipients within the scope of the Data Sharing Commitments issued by NVİGM as part of the Identity Sharing System application and within the framework of service standards, and fulfilling the requirements of the Commitments.

3. Sharing Your Personal Data with Third Parties and the Purpose for Which It Is Transferred

Your personal data is shared with public institutions, organizations, and other legal entities providing public services, as specified in Article 45, Paragraph 1, of Law No. 5490 on Civil Registration Services, by signing a Data Sharing Commitment. The list of recipient institutions is available on our General Directorate's website at https://kpsbasvuru.nvi.gov.tr/Acik/KpsNedir.

Data transfer is carried out through the Identity Sharing System in accordance with the provision in Article 8, Paragraph 2, Subparagraph "a" of Law No. 6698 on the Protection of Personal Data, "Transfer of personal data": "Transfers may be made without the explicit consent of the data subject if one of the conditions specified in the second paragraph of Article 5 (Paragraph 2 of Article 5: Explicitly provided for in the law) is met."

The institutions and their authorities with which data is shared are determined by the Data Sharing Board, established under the provision of Article 2 of Law No. 5490 on Population Services: "A Data Sharing Board shall be established within the General Directorate to determine those who will benefit from data sharing, the scope of the sharing, and the method by which it will be carried out. The operating procedures and principles of the Data Sharing Board shall be determined by a regulation issued by the Ministry."

4. Method and Legal Reason for Collecting Your Personal Data

NVİGM processes the data specified in Article 7 of Law No. 5490 on Population Services, "Personal Information Required for Family Registrations," and the data recording systems to carry out the tasks and procedures specified in Article 258 of Presidential Decree No. 1 on the Organization of the Presidency.

Relevant provision of Law No. 5490:

Personal Information Required for Family Registrations
ARTICLE 7- (1) A separate family registry shall be kept for each neighborhood or village. Family registries contain the following information:
a) Republic of Turkey identification number.
b) The name of the province, district, village, or neighborhood where registered, as well as the volume, family, and individual serial number.
c) The person's first and last name, gender, father's and mother's names, and surnames, and the previous surnames of married women.
ç) Place of birth, date of birth (day, month, and year), and the date of registration in the registries.
d) Changes in personal circumstances, such as marriage, divorce, establishment or denial of lineage, death, acquisition or loss of citizenship, or corrections made by authorized authorities.
e) Religion.
f) Marital status.
g) Residential address.
ğ) Photograph.
h) Biometric data.
ı) Information regarding guardianship and tutelage. The records specified in clauses (a), (g), (ğ), (h), and (ı) shall be kept only electronically.

General Directorate of Population and Citizenship Affairs
ARTICLE 258 – (1) The duties and responsibilities of the General Directorate of Population and Citizenship Affairs are as follows:

a) To carry out studies on the determination of policies to be followed based on the structure, characteristics, population movements, and developments in these areas, in cooperation with relevant institutions, and to ensure the implementation of the established principles.

b) To monitor and evaluate population movements, establish a central population data bank, collect family and life statistics data, and publish them in cooperation with relevant institutions.

c) To organize, execute, monitor, supervise, and evaluate population services, decide on the deletion of improperly established records, correct factual errors, combine family records, complete duplicate records and delete others, and coordinate with other ministries, institutions, and organizations regarding population services.

ç) To carry out procedures related to the acquisition, loss, and admission as an immigrant, and to enforce laws related to citizenship, resolve citizenship disputes, and conduct citizenship investigations.

d) To process identity cards. To determine the effective, amendment, and validity dates and to determine the system and technology to be used in the production of identity cards.

e) To determine the information contained in passports, passport substitute documents, and driver's licenses.
